These terms govern the use of the Tap and Know products and web application and the ancillary services available through it. Access is granted via the purchase of our products. By utilizing the application, you consent to a legally binding agreement between yourself and Tap and Know. The terms are segmented as follows:

 

Part A (All Users): This section applies universally to all users, including Tap and Know product owners who have purchased a Tap and Know product and have populated their unique web communication page, and tag viewers who utilise the information on the communication webpage.

Part B (Tap and Know product Owners): This section specifies additional terms applicable exclusively to product owners.

Notice: Prior to using the service, thoroughly review these terms. If you do not consent to these terms, refrain from using the service. Amendments to these terms may occur, and your continued use of the service post-modification implies acceptance of the altered terms.

 

Part A: All Users

 

Eligibility:

You affirm that you are either over 18 years old and using the service for personal purposes, or under 18 and have secured parental or guardian consent. Do not access the service if you do not meet these conditions or have been previously banned from its use.

User Obligations:

You commit to avoiding any form of harassment, impersonation, or unlawful activities. You agree not to share your account, to immediately report any unauthorized use of your account or security breaches, and to refrain from using the service for unauthorized commercial purposes.

Acknowledgments and Disclaimers:

You acknowledge that the service and the features and information are provided on an “as is” basis and are subject to change. You assume all risks associated with user interactions, as Tap and Know does not undertake background checks of its users or guarantee specific outcomes from using the service.

Support:

In the event of technical issues, you are instructed to contact Tap and Know for assistance. We will endeavour to resolve issues within a reasonable timeframe, though we are not liable for delays beyond our control.

Service Limitations:

The service is provided without warranties of continuous availability, error-free functionality, or data security. Any content transmitted through the service is done at your own risk.

Intellectual Property:

The materials within the service are protected by intellectual property laws and are intended solely for enabling your use of the service, subject to statutory allowances and explicit permissions by Tap and Know.

Security:

You are responsible for securing the devices through which you access the service. Tap and Know disclaims liability for any unauthorized access or damage to your data or devices.

Liability:

Liability is limited to $100 AUD for any form of loss or damage connected with the use of the service, except as prohibited by law.

Privacy:

Termination:

Tap and Know reserves the right to terminate access to the service at any time, without notice. You may also terminate your use of the service at any time.

Location of Services:

The cloud based service is managed from South Australia, and international use is subject to compliance with local laws.

Communications must be written in English and sent via email. Notices are deemed delivered 24 hours after email transmission, or upon confirmed receipt.

Dispute Resolution:

Disputes should be resolved through mediation and, if necessary, arbitration. Efforts should be made to settle disputes amicably and avoid litigation.

General Provisions:

This agreement is governed by the laws of South Australia, Australia, and includes detailed terms on legal jurisdiction, severance, costs, and assignment, designed to clarify legal rights and obligations.

Part B: Tap and Know product owners

 

Accounts:

To access the service functionalities, is enabled via the supplied unique password. This password must be kept secure at all times. If your password is lost, you will not have the ability to edit your communication page.

Posted Materials:

Materials posted on the service must comply with intellectual property laws and not contain harmful or offensive content. Tap and Know reserves the right to remove such materials at its discretion.
